Civil Law Court Orders Labour Ministry To Conduct Election For FAAWUL, AWUL Workers

Monrovia – The Civil Law Court at the Temple of Justice in Monrovia has ordered Ministry of Labour to conduct an election within a period of two weeks for the Firestone Agricultural Workers Union of Liberia.

The court’s order ends a month-long dispute over the holding of an election within the agricultural workers union.

Both the Agro-Workers Union (AWUL) and that of a group known as the Concerned Due Payers of FAAWUL have been contending over the holding of election after the expiration of the tenure of the current leadership of FAAWUL on ground that AWUL does not have the right to hold election for FAAWUL because FAAWUL is an independent body.

The Concerned Dues Payers later filed to the Civil Law Court for a declaratory judgment since the Labour Ministry declined to render them due process in hearing their complaint.

“The prime contention of the Concerned Dues Payers of FAAWUL is that the Ministry of Labor failed and neglected to hear the complaint of the petitioners consistent with due process,” said the Concerned Due Payers of FAAWUL who stated that having filed their complaint to the Labor Ministry, the Ministry did not cite or gave them their day in court.

The Ministry of Labor in response to the claim told the Civil Law Court on August 16, 2018 the Ministry of Labor filed a bill of information before the Civil Law Court that it did comply with the court’s mandate to grant the petitioners a due process instead, the Concerned Dues Payer of FAAWUL maintained and argued that they were not satisfied with the manner and form in which the hearing was conducted by the Ministry of Labor.

“The Concern Due Payers of FAAWUL failed and neglected to except to the ruling of procedure at the Ministry of Labor which exception should have a basis for further judicial action; in this jurisdiction order, ruling and judgment of any proceeding not excepted to by the party affected cannot be reviewed by the appellate court,” said the Ministry of Labor.

In its ruling the Civil Law Court says that it was observed that the crux of this matter is that the tenure of FAAWUl elected leadership or workers of Firestone Liberia has expired and there is a need for the election of a new leadership to represent the interest of the workers.

According to the court, Section 97.4 of the Decent Work Act says that in any workplace employee who are members of a registered trade union are entitled to elect from among themselves one representative, if there are more than 25 members, three representatives if there are 50 representatives, if there are more than 100 members one four representative for the first 100 days and two and additional for every additional 100 members and that the court of law does not exist in value and must take into account the development of the society and the community to preserve and protect the rights of citizens, foreigners, and aggrieved party.

“The Ministry of Labor is hereby ordered to put into motion a mechanism for the conduct of free and fair election for the workplace, union representative as the Firestone Liberia Inc. and the Ministry of Labor is further ordered to conduct said election within two weeks effective as of August 22, 2018 to September 5, 2018. And report to the court,” said the court ruling.
